How does debt relief by a repayment schedule work?

In debt relief (insolvency) by a repayment schedule with realisation of assets, the debtor pays each month the same amount that would be deducted in an enforcement for priority claims. From this amount the insolvency trustee's fee and expenses and any current maintenance are paid first; the rest is distributed to unsecured creditors. The debtor always keeps the non-seizable amount.

Debt relief usually lasts 3 years (36 months). The trustee fee is CZK 1,089 per month (CZK 1,633.50 for joint debt relief of spouses) incl. VAT. For the court to approve it, the debtor must generally be able to pay creditors at least as much as the trustee fee.
